Brand/Mark Registration Procedure in Indonesia

According to Article 1 paragraph (1) of Law No. 15 Year 2001 regarding Brand/Mark (Brand/Mark Law) states that Brand/Mark is a sign in the form of a picture, word, letters, numbers, colors, or combination of said elements, having distinguishing features and used in the activities of trade in goods or services.


Brand/Mark protection can be obtained through registration. Brand/Mark registration will offer stronger protection especially against Brand/Marks that are identical or similar.


Here are the procedures for Brand/Mark registration in Indonesia:


A) Registration Procedure

  • Filing an application to Directorate General of Intellectual Property Rights to (Ditjen HK) altogether with the required documents;
  • Providing a short description regarding the Brand/Mark that will be registered;
  • Providing statement of Brand/Mark ownership;
  • Paying the application fee.

B). Required Documents

  • Photocopy of Indonesian Citizen ID Card (individual) or Company Deed (Legal Entity);
  • Mark etiquettes (20 etiquettes);
  • Mark Ownership Statement Letter;
  • Application Form;
  • Proof of Official Payment.
